These Terms of Service (“Terms”) are a contract between you and Lumen (“Lumen”, “we”, “us”). They govern your access to and use of the Lumen website, bots, dashboards and tools (together, the “Service”). By creating an account, paying for, or using the Service you agree to these Terms. If you don’t agree, don’t use the Service.
In short
- Software on your behalf: Lumen operates on your explicit direction to automate tasks on your own educational accounts. It carries out actions on your behalf according to your preferences.
- Not for post-16 or exams: It is not available to students at a college, sixth form, university or other post-16 institution in England, or to anyone entered for a regulated exam in England, and it must never be used on exams, tests or assessed work.
- Independent: Lumen is independent. It is not connected to Sparx, Seneca, Educake, Dr Frost, Tassomai, Bedrock, Carousel, LanguageNut or your school, and using it may break their rules. That risk is yours.
- Subscriptions & refunds: Subscriptions renew until you cancel. Refunds are set out in our Refund Policy.
- Liability: Our liability to you is limited as set out in Section 11.
1 Who can use Lumen
You must be 18 or older to hold a Lumen account. If a person under 18 is going to use the Service, a parent or legal guardian must set up and hold the account, accept these Terms, and be responsible for everything done through it. Where a parent or guardian pays for the Service, they are our customer.
The Service is not offered to, and must not be used by or for, anyone who is:
- undertaking a course at a college, sixth form, university or other post-16 institution in England; or
- over compulsory school age and entered to take an examination for a regulated qualification in England.
(These are the people protected by Part 4, Chapter 3 of the Skills and Post-16 Education Act 2022.) The Service must never be used for any exam, test, controlled assessment, coursework or other work that counts towards a qualification, or for any piece of work that a course requires you to complete personally.
By using the Service you confirm that none of the above applies to you or to anyone you use it for, and you agree to tell us straight away if that changes. We rely on that confirmation. We don’t verify age or enrolment, but we may ask you to confirm these things when you sign up or at any time afterwards, and we may suspend or close an account if we learn that a confirmation was untrue.
2 What Lumen is, and what it isn’t
Lumen is an automation suite designed to assist with school homework. When you connect a supported learning platform that you are authorized to access (such as Sparx Maths, Sparx Reader, Sparx Science, Seneca, Educake, Dr Frost, Tassomai, Bedrock, Carousel, or LanguageNut), Lumen carries out the assigned exercises based on your configuration. All automated actions performed by Lumen are executed under your instruction, authority, and responsibility, exactly as if you were completing them manually.
Lumen is not a school, tutor or education provider, and it has no relationship with your school. It is not made, licensed, endorsed or approved by any of the platforms it works with, and it has no agreement with them. Each platform has its own rules, and your school has its own rules. Most platforms do not allow automated tools or shared logins. Using Lumen may therefore breach a platform’s rules or your school’s rules, and a platform or school may respond however it sees fit, including restricting or closing the connected account. You decide whether to take that risk. We are not party to those rules, we don’t police them, and we don’t promise that your use of the Service will go unnoticed by any platform or school.
3 Account Security & Credentials
You are responsible for safeguarding your Lumen credentials and ensuring all submitted information is accurate. Accounts are strictly personal (one user per account). Any platform accounts linked to Lumen must belong to you or a student under your legal care. Sharing, pooling, reselling, or trading platform logins is strictly prohibited.
When you connect a platform account you authorise us to store its login details and to use them to sign in and act on that account for you, as your agent, for the sole purpose of running the Service. You can withdraw that authority at any time by disconnecting the account or closing your Lumen account. How we protect login details is explained in our Privacy Policy.
4 Fees, credits and renewals
Prices are shown at checkout and billed in pounds sterling through our payment processor, Stripe. Paid subscriptions renew automatically each period (weekly or monthly) until you cancel. You can cancel at any time through the billing portal or by opening a support ticket in Discord, and you keep access until the end of the period you’ve already paid for. Free trial access or credits have no cash value and can be changed or withdrawn at any time. We may change our prices, but a change won’t apply to you until we’ve told you and your subscription next renews, so you always have the chance to cancel first.
When you buy, we ask you to confirm that you want the Service to start straight away, inside the 14-day cancellation period that applies to purchases made online. If you then cancel within those 14 days, you pay for the part of the period you’ve had and we refund the rest according to our Refund Policy.
5 Acceptable use
You agree not to:
- use the Service in breach of Section 1, including for any exam, test, controlled assessment, coursework or other assessed work;
- connect or use a platform account you aren’t entitled to use, or share, pool or trade logins;
- resell, sublicense, rent or share access to the Service unless you’re an approved reseller under Section 9;
- copy, modify, reverse-engineer, scrape, overload, interfere with or attack the Service, or use it to attack or overload any platform it connects to;
- use the Service for anything unlawful, to harm anyone, or to infringe anyone’s rights; or
- abuse our staff or other users, or raise a payment dispute with your bank without contacting us first.
Whether and how you use Lumen at your school is between you and your school. We’re not party to that relationship.
6 Platforms can change, block or disappear
Lumen depends on how each supported platform works today. Platforms can change their systems, block automated access, lock accounts or shut down at any time, without warning to us. If that happens, your access to that part of the Service may be limited, paused or withdrawn, and we may add, change or remove supported platforms and features at any time. We’ll do our best to keep things running, but we can’t promise uninterrupted access to any given platform. If we permanently withdraw the only platform you use partway through a paid period, we’ll refund the unused part of that period.
7 Accuracy and results
We’ll provide the Service with reasonable care and skill. Beyond that, we don’t promise any particular level of accuracy, mark, grade, streak, completion rate or outcome. Answers submitted through the Service are generated automatically and may be wrong. It’s up to you to check what has been done on your account.
8 Intellectual property and trademarks
Lumen, its software, branding and content belong to us or our licensors. We give you a personal, non-transferable licence to use the Service under these Terms, and nothing else. Sparx, Sparx Maths, Sparx Reader, Sparx Science, Seneca, Educake, Dr Frost, Tassomai, Bedrock, Carousel, LanguageNut and any other platform names on this site are trademarks of their respective owners. We use them only to identify the platforms the Service is compatible with, and for no other purpose. We are not affiliated with, endorsed by, sponsored by or connected to any of them, and we don’t copy, host or redistribute their content.
9 Resellers
Reseller access is available only under a separate written agreement with us. Resellers are independent businesses, not our agents, partners or employees, and they have no authority to make promises on our behalf. A reseller must pass these Terms on to their own customers, must not offer the Service to anyone excluded by Section 1, and is responsible for their own customers’ use and for complying with the law that applies to them. We can end reseller access at any time for breach of these Terms or the reseller agreement.
10 Suspension and closing accounts
We can suspend or close your account, with or without notice, if you break these Terms, give us an untrue confirmation under Section 1, share or pool logins, raise a payment dispute without contacting us first, or if we reasonably believe your use puts us, other users or the Service at legal, security or operational risk. If we close your account for your breach, you are not entitled to a refund of the current period. If we close your account for any other reason, we’ll refund the unused part of any period you’ve paid for. You can stop using Lumen and close your account at any time.
11 Our liability to you
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to limit or exclude. If you’re a consumer, nothing in these Terms affects your statutory rights.
Subject to that:
- we’re not liable for any action a platform, school, exam board or other third party takes because of your use of the Service, including locking or closing a connected account, marks being removed, or disciplinary or academic consequences;
- we’re not liable for losses caused by your breach of these Terms, of a platform’s rules or of your school’s rules, or by an untrue confirmation under Section 1;
- we’re not liable for wrong answers, for any mark, grade or outcome, or for events outside our reasonable control, including changes made by a platform;
- we’re not liable for indirect or consequential loss, or for any business loss, loss of profit or loss of opportunity; and
- our total liability to you for all claims relating to the Service is limited to the amount you paid us in the 3 months before the claim arose.
12 You cover us for your breach
If a third party, including a platform, school or exam board, makes a claim against us, or we suffer a loss, because you broke these Terms, misused the Service, or gave us an untrue confirmation under Section 1, you agree to cover the reasonable losses, costs and expenses we incur as a result.
13 Nobody else has rights under these Terms
These Terms are between you and us only. No one else, including any platform, school or exam board, has any right to enforce any part of them, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
14 Changes to the Service and these Terms
We may change the Service, including which platforms and features are supported, at any time. We may also update these Terms. If a change to the Terms is material, we’ll give you at least 14 days’ notice through Discord before it takes effect, unless the change is needed for legal or security reasons. If you don’t agree to a change, cancel before it takes effect. Continuing to use the Service after that date means you accept it.
15 Governing law and disputes
These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts. Nothing in these Terms removes any protection you’re given by the mandatory consumer law of the country you live in. If you have a problem, please contact us first. Most things can be sorted out quickly.
16 General
These Terms and our policies are the whole agreement between you and us about the Service. If any part of these Terms is found to be unenforceable, the rest still applies. If we don’t enforce a right straight away, we can still enforce it later. We may transfer our rights and obligations under these Terms to a successor business; you may not transfer yours. Apart from the limited authority you give us in Section 3 to act on your connected account, nothing in these Terms makes either of us the agent, partner or employee of the other. We may send you notices through Discord or email.
